Terms and Conditions – Booking Copy
1. This Docket / Consignment Note (CN) shall also be regarded as a goods forwarding note between owners or dispatchers of the goods and Raptaar.
2. The goods are booked on a "Said to Contain" basis without verifying contents; the nature, quality, condition, and value of the subject docket (CN) are unknown to Raptaar. Raptaar has accepted the same as packed and declared by the owners, i.e., the consignor, in good faith
for transportation as indicated on the face hereof. The consignor shall ensure to make correct and factual declarations in these goods forwarding note/CN. The consignor shall indemnify Raptaar and its officials against all claims, losses, freight, actions, and damages incurred
by Raptaar due to any banned, restrictive, or dangerous goods entering into its network or any proceedings initiated against Raptaar due to any omission or commission of the consignor, including improper documents or false statements. Raptaar reserves the right to refuse
the booking of any shipment not conforming to the terms or with inadequate packing.
3. The consignor shall hand over the goods to Raptaar duly accompanied by valid and correctly filled documents/forms/permits as required under Sales Tax regulations. Raptaar shall intimate the consignor immediately regarding confiscation of the goods, if any, by Sales Tax
Authorities, and the consignor undertakes to secure their release within 24 hours if seized due to improper documents or false declarations. In case the consignor fails to release the goods within 24 hours, Raptaar reserves the right to claim detention or any other charges
incurred, apart from any liability imposed on Raptaar due to the seizure of goods in transit.
4. The consignor/consignee shall, without any limitation, be solely liable to the company for all costs and expenses, including octroi, other taxes, or import levies related to the consignment carried under the docket (CN). The costs of warehousing and returning the docket (CN)
to the consignor/consignee, if desired by them and agreed upon by the company, shall also be borne by them.
5. Demurrage will be charged after seven (7) days of arrival at the destination at ₹1 per kg per day or 0.1% of the invoice value, whichever is higher, in case delivery is not completed within the stated period.
6. In case of any damage or loss to the consignment during transit, the liability of Raptaar is limited and restricted only to issuing a "Certificate of Facts," which shall be the least of the cost of repairs or the amount mentioned on the Consignment Note. The certificate of facts shall
be issued along with a joint survey report enabling the consignor to settle claims with their underwriter/insurer. In case of a credit transaction, if the bill is not paid on or before the due date, any claim arising from such a transaction shall not be entertained. The consignor/consignee
shall not be entitled to set off/adjust the freight arbitrarily against any claim made by them on the company. Any violation thereof shall attract an interest charge of 2% per month on the adjusted/deducted amount. The consignor/consignee shall not exercise lien/deduct/adjust
any amount due to the loss of MODVAT copy/excise gate pass. Under no circumstances should the freight be linked to the claim amount, irrespective of the mode of freight.
7. Lien on Consignment: Raptaar shall have a general lien on the consignment if the consignor/consignee fails to pay transportation charges or any other charges or expenses incurred by the company concerning the docket (CN), whether due to local state rules or any other
reason.
8. Any or all claims for loss or damage must be lodged by the consignor/consignee in writing within seven (7) days after the completion of transit of the docket (CN). Any such claim by the consignor/consignee after the expiry of 7 days shall not be entertained. Raptaar shall
accept no claim if the consignee has received the goods at the destination and affixed its signature/seal.
9. Except under exceptional circumstances and/or for valid reasons, and only after the payment of all dues in respect of the original outward transit and the return transit, the subject consignment will be rebooked solely at the discretion of Raptaar. The company will not be
responsible for any damage or shortage in rebooked consignments.
10. Delivery time shall be subject to a cutoff time of 1600 hours to hand over the goods to Raptaar. If goods are handed over after the cutoff time, the booking date shall be considered the next day, regardless of what is written on the CN. However, the delivery of goods shall be
subject to proper declarations with complete and correct documents/permits provided by the consignor. In case of Sunday or a public holiday, the delivery date will be extended to the next working day. Delivery assurance shall not be applicable in cases of force majeure,
including acts of God, floods, accidents, strikes, political disturbances, or any other event beyond Raptaar’s control.
11. Undelivered or Unclaimed Goods: If Raptaar is unable to deliver the docket (CN) to the consignee or as per their instructions for any reason, it reserves the right to sell or auction the goods to recover its freight, outstanding charges, storage fees, and other related costs.
The consignor/consignee shall indemnify Raptaar against all liabilities concerning such goods, their storage, and related costs.
12. Any dispute or difference arising between the parties out of or relating to this consignment note shall be settled by arbitration per the provisions of the Arbitration and Conciliation Act, 1996 (as amended). The arbitration shall be conducted by a sole arbitrator appointed by
Raptaar, and the arbitrator's decision shall be final and binding on both parties. The venue for arbitration shall be Cuttack, Odisha.
